1) Expo Data Capture agrees to the delivery of services as specified and is to be rendered in a timely and professional manner according to standard industry practices. All equipment and software remains the sole property of Expo Data Capture .

2) The method of payment shall be in United States dollars and submitted by credit card with the order for service via the on-line form given. If the Renter/User of Lead Retrieval equipment wishes to pay by check, then the directions given in the FAQ section regarding check payment must be followed. Expo Data Capture will only accept checks drawn on banks located in the United States of America or certified funds. If the Renter/User wishes to fax their credit card information, they register via fax.

3) The Renter/User has been informed by Expo Data Capture that the Lead Retrieval equipment can be used to collect information, provided by the attendees on their registration forms, from the registration database such as: Attendee Name, Title, Company, Address, Phone, Fax, E-Mail etc. Information included is subject to the information designated by each event’s management to be captured and may vary from event to event. By properly using the Lead Retrieval equipment, the Renter/User will be able to scan and record bar coded information available on the badges of individuals who are interested in the Renter/User’s product or service. Renter/User understands and accepts that some badges issued by show management at on-site registration may not have bar codes and unique ID numbers to allow for expedience during on-site registration. This is at the discretion of show management and is not the fault of Expo Data Capture .

4) Lead Retrieval equipment must be picked up at the show site from the “Lead Retrieval” designated area (registration will direct you to the area). Equipment not picked up within 5 hours after the start of the show may be re-rented without any refund. At the end of the rental period, the Renter/User will return the Lead Retrieval equipment to the “”Lead Retrieval” contact in the designated location. Lead Retrieval equipment that is not returned within 1 hour of the close of the show will be subject to a $150.00 late charge beginning the night the show closes and $150.00 for every day thereafter until the Lead Retrieval unit is returned to Expo Data Capture.

5) The Renter/User agrees to return any equipment to Expo Data Capture in the same condition as it was picked up. The Renter/User agrees to the immediate payment, upon request by Expo Data Capture, for all damages or loss of equipment, except such as may result from normal operation thereof; and the customer acknowledges and understands that the applicable replacement cost is as follows: The Renter/User authorizes Expo Data Capture to charge the credit card used for payment, a $2500.00 replacement cost for either the failure to return the equipment or for any damaged equipment. EQUIPMENT LEFT IN THE EXHIBIT AREA IS THE RESPONSIBILITY OF THE RENTER/USER.

6) Expo Data Capture’s liability for damage of any cause whatsoever will be limited to the total price for the goods and services provided by Expo Data Capture.

7) It is agreed that the governing law pertaining to this contract will be the laws of the State in which this show takes place.

8) As with any technology and equipment, the Lead Retrieval units must be handled properly and used as directed in order to achieve the desired results. The Renter/User, upon picking up their Lead Retrieval Equipment on-site, will receive instruction on the correct use and care of the Lead Retrieval equipment and will acknowledge in writing that he/she, or an authorized employee, has been instructed by Expo Data Capture and understands how to operate the Lead Retrieval equipment. Improper use of the Lead Retrieval equipment can result in the Lead Retrieval unit’s failure to record the desired information. The Renter/User further acknowledges and agrees that, by this agreement, the liability to Expo Data Capture for the Lead Retrieval unit’s failure to record and retain recorded information, for whatever reason, is limited to the return of the Lead Retrieval equipment rental costs. The Renter/User and their company hereby waive all other rights and remedies that they have against Expo Data Capture if the Lead Retrieval equipment does not record all information which they attempted to obtain.

9) Force Majeure. Expo Data Capture shall not be held responsible in the event acts of God, war, government regulations, disaster, terrorism, strikes or threat of strikes, lockouts, civil disorder, curtailment of transportation facilities or services, fires floods, epidemics, accidents, shortages, acts of any governmental authority or other catastrophic events hinder the ability to provide lead retrieval equipment and service to show site or exhibitor.

10) Refunds/Cancellation Policy: Expo Data Capture must receive cancellation request in written form, at the address on this agreement by the Advanced Registration Price Date. Requests for cancellation that are received by this deadline will be refunded in the amount equal to seventy five (75%) percent of the total price of the order. No cancellation requests or refunds will be accepted after this date. Expo Data Capture will not be held responsible for refunds due to cancellations or delays in the programming due to acts of God, war, government disorder, curtailment of transportation facilities, or other emergency making it inadvisable, illegal, or impossible to hold the show.
